Section 1: Executive Summary

1. Background

Since protease inhibitors became available in 1996, combination antiretroviral therapy has led to significant improvements in the health of many persons living with HIV/AIDS (PHAs). As these PHAs regain their health, AIDS Service Organisations (ASOs) are being required to respond to an emerging need for programs and services designed to assist those who want to return to the workforce. This need presents a significant challenge to the way ASOs have traditionally provided information, education and support.

2. Aims and Objectives

In 1997, the AIDS Committee of Toronto (ACT) commissioned this study with the objective of assessing:

  • The return-to-work issues being experienced by PHAs
  • The vocational rehabilitation services available at non-HIV/AIDS agencies
  • The suitability of these programs to respond to the needs of PHAs and the potential for alliances/partnerships with these agencies
  • What return-to-work programming has been established at ASOs elsewhere in Canada and in one or two major centres in the United States
  • What documentation exists on return-to-work programs and issues for PHAs
  • What government programs are available in this area and whether they are a potential source of partnership or funding.

The study also includes an assessment of:
  • What types of return-to-work programming need to be established at ACT
  • What partnerships should be pursued with other agencies that have existing vocational rehabilitation services and
  • What sources of funding are available (including the potential for a pilot study).

3. Methodology

Between September and November 1997, ASOs were consulted in Toronto, elsewhere in Canada and in the United States. Existing Information about PHA needs and return-to-work programming was gathered and documented.

Consultations were also held with the Canadian insurance industry, federal and provincial government welfare, rehabilitation and benefits agencies, health care workers and community-based vocational rehabilitation services in Metro Toronto.

A PHA needs assessment was conducted using a self-administered questionnaire and facilitated focus group discussions at an action research forum in Toronto attended by 21 PHAs.

4. Findings

Numerous barriers to the effective reintegration of PHAs into the workforce were identified, particularly in relation to current income support programs, long term disability plans and psychosocial issues. However, significant opportunities exist for programs and partnerships aimed at overcoming these barriers.

Although the study primarily addresses issues for PHAs in Toronto, it contains information which may assist return-to-work planning by ASOs in other Canadian urban centres.

5. Recommendations

The study recommends a range of potential return-to-work strategies for ACT, including:
  • Possible short-term programs and activities
  • The development of a pilot study in vocational rehabilitation for PHAs in partnership with government and industry
  • The expansion of current benefits advice services offered by ASOs in Toronto and the development of relevant education and information material
  • HIV in the workplace information and education programs
  • Other education and information strategies for PHAs, vocational rehabilitation agencies and the insurance industry.

Section 2: Project Overview

2.1 Background

Over the course of the HIV epidemic, retirement from the workforce, either due to illness or in order to preserve one's existing emotional and physical health, has become one of the many rites of passage for a person living with HIV or AIDS (PHA). HIV infection and its consequent assault upon the immune system have signalled for most PHAs the prospect of perhaps 10 years - though often less - of inexorable decline into illness and eventual death. AIDS service organisations (ASOs) have become adept at helping PHAs manage this transition into illness and disability. Until recently, few service providers or PHAs had expected that leaving work would be (for most) anything but a permanent state of affairs.

Since 1996, advances in monitoring HIV viral load and treating HIV infection have altered this prognosis for many - though not all - PHAs. However, it remains the case that these advances do not represent a cure for HIV infection. The benefits of combination therapy have not been experienced universally, the long-term efficacy of the new drugs remains unknown, the capacity to tolerate side effects varies widely between individuals and complex treatment regimens have added new challenges to the lifestyles of PHAs. The treatments which have improved the prognosis for many PHAs also come at great expense to the health care system.

It is in this uncertain climate that many PHAs are nonetheless daring to contemplate the prospect of living an extended or even "normal" lifespan, and pursuing life options which they may have thought lost to them. For some, this includes the possibility of returning to the workforce, either to previous occupations or professions or in entirely new fields. Other PHAs feel that improvements in their health, combined with a tightening of eligibility for social assistance or pressure from disability insurers, could make a return-to-work inevitable.

Many PHAs have been out of the workforce for a number of years and feel unsure about their ability to deal with the demands of the modern workforce. Equally, there is uncertainty and apprehension about the extent to which the work environment is sufficiently flexible to accommodate the needs of people living with a chronic illness, especially one which has been as stigmatised as HIV.

Beginning to think about the future again, and the possibility of returning to paid work, can be a frightening and confusing process for any person with a chronic illness. It is a process which involves weighing risks and taking leaps into the unknown. Without any assurance that improvements in health can be sustained, disability benefits have offered and continue to offer security of income for many PHAs, together with an assurance that the enormous cost of the new HIV treatments will continue to be met. But it is becoming clear that many people are now looking toward the future with more optimism and are entertaining options that until quite recently were unimaginable.

The challenge for many PHAs and those providing services to them now lies in translating the gains which have been made in physical well-being into a sustained capacity to envision and plan for the future. Thinking about and preparing for a possible return to work - however tentatively and regardless of whether a job is the eventual result - is just one way in which new visions of living with HIV might be attained.

2.2 Introduction

In the last 12 months, some ASOs have recognised the need to provide services aimed at assisting those of their clients who have benefited sufficiently from advances in treatment to think about returning to work. However, the provision of practical and emotional support about returning to work demands a significant mind-shift for organisations more accustomed to helping people leave the workforce and - in partnership with other health care providers - to deal with illness, grief and loss.

The AIDS Committee of Toronto (ACT) has recognised that HIV/AIDS is changing and that providing appropriate return-to-work services for its clients involves new challenges for the organisation. ACT - like other ASOs - is entering new terrain. To meet these challenges, it must enter partnerships with other service providers and communities and provide its clients with information and support which enables them to take control of their own lives. It is hoped that this feasibility study represents a preliminary step in that direction.

2.3 Aims and Objectives

This study was commissioned by ACT in July 1997 to make an assessment of the following issues:

1. The needs of PHAs regarding return-to-work issues.

2. The vocational rehabilitation programs available at non-HIV/AIDS agencies.

3. The suitability of these programs to respond to the needs of PHAs and the potential for alliances/partnerships with these agencies.

4. Return-to-work programming that has been established at ASOs elsewhere in Canada and in one or two major centres in the United States.

5. Existing documentation on return-to-work programs and issues for PHAs.

6. Government programs available in this area and their potential as sources of partnership or funding.

The project was also required to include recommendations regarding the design of return-to-work programming for PHAs at ACT, including:

1. What types of programming need to be established at ACT.

2. What partnerships should be pursued with other agencies that have existing vocational rehabilitation services, and

3. What sources of funding are available (including the potential for funding a pilot study).

2.4 Methodology

The following methods were employed during the course of the study and in the production of this report:

2.4.1 Literature Search

An extensive search was made of HIV-related websites and associated databases in North America and Europe. Further literature was obtained from the ACT library and in the course of discussions and consultations with individuals and ASOs in Canada and the United States. The literature obtained contains further extensive references to other work done in this area.

2.4.2 Consultations

Within a 10-week period between mid-September and mid-November 1997, consultations were conducted with the following groups and organisations:

a. AIDS service organisations in Metro Toronto

Key informants from the following community-based ASOs in Metro Toronto were interviewed to assess their client/members' current thinking about return-to-work issues and their present or prospective need for vocational rehabilitation and employment-related services:

AIDS Committee of Toronto (ACT), Toronto PWA Foundation (TPWAF), Community AIDS Treatment Information Exchange (CATIE), Black Coalition for AIDS Prevention (BlackCAP), Asian Community AIDS Services (ACAS), Voices of Positive Women (Voices), Prisoners and AIDS Support Action Network (PASAN) and Africans in Partnership Against AIDS (APAA).

In most cases, the person interviewed was a support worker or other person having direct contact with PHAs who use the organisation's services. In the case of ACT and TPWAF, meetings were held with benefits counsellors and case managers. Where possible, interviews were conducted in person. Some interviews were conducted by telephone.

b. AIDS service organisations elsewhere in Canada

Telephone discussions were held with the Canadian AIDS Society (CAS), British Columbia Persons with AIDS Society (BCPWA) and MIEL Quebec about their work in this area. CAS provided valuable referrals to American ASOs.

c. AIDS service organisations in the United States

Telephone discussions were held with several ASOs in the United States. Referrals from these organisations to experienced individuals were also pursued. Where possible, relevant literature about their current return-to-work programming was obtained.

d. Insurance industry

Meetings were held with the Canadian Life and Health Insurance Association (CLHIA), Manulife Financial (the largest insurance company in Canada) and preliminary contact was made with Mutual Insurance. Several private benefit consultants provided input. The study consultants also attended a meeting of the Canadian Insurance Underwriters Association.

e. Social assistance agencies

Meetings or telephone discussions took place with individuals from Human Resources Development Canada (Canada Pension Plan (CPP) and Employment Insurance (EI)) and Ontario Family Benefits Allowance (FBA), General Welfare Assistance (GWA) and Vocational Rehabilitation Services (VRS).

f. Vocational rehabilitation (VR) service providers

The study consultants attended a meeting of community-based VR service agencies in Metro Toronto hosted by TPWAF in October 1997. Follow-up contacts were made with some of those organisations, while a number of others were consulted by telephone.

g. Health care workers

A meeting was held with staff at Sunnybrook Health Sciences Centre's HIV Outpatient Clinic to obtain a snapshot of the experiences of health care providers with return-to-work issues for PHAs.

2.4.3 Action Research Forum

A half-day action research forum held in late October 1997 was attended by 21 PHAs who were presently on disability and thinking about returning to work. The workshop consisted of three components:

a. An information session exploring issues likely to influence decision-making around returning to work.
The purpose of this session was to provide participants with information which might assist them to more fully consider their particular needs and concerns about returning to work.

Separate speakers addressed issues for those receiving disability benefits through a form of social assistance (FBA, CPP, and GWA), and issues for those receiving Long Term Disability (LTD) benefits through an employer, group or private plan. A third speaker discussed his own experiences as a PHA who had recently returned to the workforce.

b. Completion of needs assessment questionnaire.

c. Small focus groups to expand upon issues arising from the information session and in the questionnaire.
  • The questionnaire completed by participants at the end of the information session, and the focus group questions, appear in Appendix A.

Participants for the forum were recruited through an advertisement in Xtra! and through the distribution of a flyer to ASOs and HIV outpatient and primary care clinics. As the number of possible participants was limited, expressions of interest were not accepted on a first-come, first-served basis. Rather, attempts were made to ensure gender and ethnocultural representation and a balance between people receiving disability benefits from public and private sources. Participants were paid an honorarium of $50 for their attendance.

2.4.4 Project Advisory Committee

A committee of representatives of ACT, TPWAF and a person living with HIV who had returned to work met formally on two occasions to monitor the progress of and provide input into the project.

The committee reviewed a draft of the questionnaire used at the action research forum and a draft of this report.

Section 3: Overview of the Literature and Documentation Obtained

3.1 HIV in the Workplace

There is already a large body of literature, much of it from the United States, dealing with the issue of HIV in the workplace. Much of this literature is aimed at appraising employers and managers of their rights and responsibilities in regard to employing persons with HIV (and persons with other disabilities) and meeting obligations arising under disability discrimination legislation. For example, the Business and Labor Resource Service of the Centers for Disease Control and Prevention (http://www.brta-lrta.org) documents a plethora of guidebooks, policy papers and other documentation informing employers about reasonable accommodations, disability insurance, model anti-discrimination policies, occupational health and safety issues and employee/family education programs. This literature comes in a variety of forms and from many sources including AIDS and disability service and advocacy organisations, government civil rights and social assistance agencies, trade unions and employer/industry associations.

An equally large body of literature from the US is aimed at PHAs and people with other disabilities, addressing similar matters as well as further issues such as pre-employment HIV testing and disclosure (an example is the National AIDS Fund's HIV/AIDS: A Guide for Employees, 1994).

Canadian literature which addresses HIV in the workplace issues includes the CAS AIDS in the Workplace manual, the Canadian Human Rights Commission pamphlet HIV and Discrimination in the Workplace, the flyer Know Your Rights: AIDS and AIDS-related Illnesses and the Human Rights Code (Ontario Human Rights Commission, 1993) and AIDS and Workplace Policy (Canadian Public Health Association, 1997).

3.2 Insurance, Benefits and Leaving Work

A wide range of literature for PHAs has focussed on leaving work and legal/financial issues such as accessing insurance and disability benefits. Examples from the United States include Social Security Benefits for PHAs (US Social Security Administration, May 1994) and The Benefits Game: Solving the Puzzle of Insurance and Government Benefits (AIDS Legal Referral Panel of the San Francisco Bay Area).

Canadian ASOs and government agencies have produced some literature dealing with eligibility for disability benefits. This includes Health Canada's series Meeting the Income Support Needs of People living with HIV/AIDS, and CAS's forthcoming Guide to Insurance Benefits for People living with HIV/AIDS (currently in draft form and expected to be available early in 1998). CAS has also produced a number of recent briefing papers dealing with HIV-related poverty and problems with current income replacement programs available to PHAs.

This report does not deal in further detail with literature about HIV in the workplace issues, or literature designed to assist people to leave the workforce. However it is acknowledged that combination therapy will not only contribute to some PHAs re-entering the workforce, but is likely to result in far greater numbers of PHAs remaining in their current employment.

The need for workplace HIV education is therefore likely to be greater than ever before. However, recent data from the National AIDS Fund suggests that, at least in the United States, such programs are actually less common than they were five years ago “AIDS Training at Work Less Common”, Crain’s Chicago Business, 10 November 1997. This issue is the subject of further comment and recommendation later in this report.

3.3 Return-to-Work and Vocational Rehabilitation for PHAs

There is now a growing body of literature dealing with "return-to-work" issues for PHAs. Some of this material has emerged as part of general media hype about "the end of AIDS?" since the XI International Conference on AIDS in 1996. In some ways "return-to-work" has become a "pin-up" AIDS issue, emblematic of the changing face of AIDS since the advent of combination therapy.

Other material focuses on work being done in this area by ASOs and AIDS advocacy organisations. This section provides an overview (not necessarily exhaustive) of current relevant documentation, most of which has been produced in the last 12 months.

3.3.1 General Media, Journals and Newsletters

A range of general media articles dealing with the improved prognosis for PHAs has appeared over the last 12 months. In 1997, articles dealing specifically with PHAs returning to work have appeared in such publications as The Wall Street Journal, USA Today and The San Francisco Chronicle. AIDS Policy and Law, AIDS Treatment Update, the newsletter of the National AIDS Fund and the Australian National AIDS Bulletin have all covered this issue.

Of special interest is the July 1997 issue of Focus, a monthly publication of the AIDS Health Project, affiliated with the University of California San Francisco. This is devoted entirely to the return-to-work issue and contains several informative articles on psychosocial aspects of returning to work, as well as references to academic studies on the relationship between employment and health for people living with HIV/AIDS.

3.3.2 Research, Policy and Advocacy Documentation

a. Canada

CAS’s government briefing paper The Federal Role in Disability Issues: Implications for Persons Living with HIV/AIDS (October 1996) outlines a number of broad policy issues in this area. These include disincentives to labour force participation by PHAs as a result of the inflexibility of current income support programs, restrictive taxation mechanisms which prevent people with disabilities from offsetting drug and other costs, legal issues including access to federal discrimination mechanisms, same-sex spousal benefits and immigration. CAS's A Guide to Benefits for Persons Living with HIV/AIDS is referred to in Section 3.2 above.

In September 1997, BCPWA released its document Issues and Guiding Principles for Return to Work, Vocational Rehabilitation and Rehabilitation Services in the Context of HIV. This document emphasises the right to self-determination for PHAs in electing to return to work, and the need for flexible rehabilitation options which accommodate the cyclical, recurrent nature of HIV disease.

b. United States

Many large ASOs in the United States have begun either to develop or implement programs and services aimed at assisting PHAs to return to work. A variety of documentation about these programs was obtained.

i. Northwest AIDS Foundation (NWAF), Seattle

NWAF conducted a "Back to Work Survey" of PHAs in March 1997 to assist with planning its programs and services. In September 1997, NWAF published Returning to Work: New Horizons for Individuals Living with HIV/AIDS. This document is a reference manual to help PHAs navigate federal and state disability programs. The manual contains a summary of the major United States disability programs, their work incentive schemes and trial work periods allowed under them. A series of worksheets enables PHAs to calculate the impact of work-related income on disability entitlements. Information about housing, health insurance and referrals to local organisations are included.

ii. AIDS Project Los Angeles (APLA)

APLA's Assisting Persons Living with HIV/AIDS to Return to Work: Findings from Three Focus Groups (April 1997) outlines PHAs’ motivations for returning to work, obstacles to employment, and preferred employment options (largely focussed on computer-related jobs). Recommendations in the report include the development of a vocational assessment process, identification of flexible employment options, provision of both counselling and information on benefits, development of information and referrals to vocational training and education services, and employer education.

iii. Gay Men's Health Crisis (GMHC), New York

In July 1997, GMHC, in collaboration with Mobilizing Talents and Skills (MTS) and the National Association of People with AIDS (NAPWA), conducted a two-day public policy roundtable on returning to work with HIV/AIDS. Representatives from several Canadian ASOs and advocacy organisations attended the meeting. The minutes of the meeting outline guiding principles for return to work initiatives, public policy priorities (welfare reform), education and advocacy priorities (including HIV education for government benefits and VR workers), the need for incentives for employers to hire PHAs and further research to demonstrate the economic advantages of PHAs returning to work. The Canadian participants developed their own set of policy priorities, and these have been incorporated into the guidelines developed by BCPWA (see 3.3.2 above).

iv. National AIDS Fund (NAF), Washington DC

NAF has taken a significant lead on the return-to-work issue in the United States through its Return to Work Initiative (RTWI). The RTWI aims 1) to provide resources to PHAs, 2) to perform outreach, motivation, support and education to employers and the business sector and 3) to perform advocacy on income replacement and benefits in the insurance industry.

The NAF-RWTI has published proceedings from policy roundtables it has held with PHA organisations, employers and (not yet available) the insurance industry. NAF also publishes a monthly newsletter which provides updates on the RTWI. The NAF website also contains references to thousands of books, periodicals and videotapes related to managing HIV/AIDS in the workplace.

Amongst NAF’s most recent publications are Return to Work Issues for Persons Living with HIV/AIDS: A Health and Medical Checklist (1997) and Return to Work Issues for Persons Living with HIV/AIDS: A Personal Assessment Tool (1997). The “checklist” sets out basic health and medical questions which PHAs should ask themselves and/or their physician when thinking about returning to work. These include current clinical results, a self-assessment of daily activities and energy-levels, capacity to tolerate stress, cognitive skills and levels of depression and anxiety.

The “personal assessment tool” provides an extensive overview of issues for PHAs to consider, including a checklist designed to help assess 1) the pros and cons of returning to work and 2) what kind of work to do (is the motivation job satisfaction or supplementing income? What skills does the person have or could s/he acquire?) There is a lengthy section examining issue of disclosure to prospective employers including testimonies from PHAs as well as people with other disabilities, such as multiple sclerosis.

NAF is also preparing an annotated bibliography of return-to-work materials. NAF materials are available from http://www.aidsfund.org.

v. Betty Kohlenberg, San Francisco

Kohlenberg is a vocational counselling consultant who has written extensively about psycho-emotional aspects of returning to work with HIV. She focuses on practical issues such as disclosure, handling difficult questions during interviews (eg explaining gaps in a resumé) and asking for accommodations in the workplace. Her publications include Answering Illegal Interview Questions (1997), Answering the Hardest Interview Questions: Why Did You Leave Your Job? What Have You Done Since Then? (1997) and Discussing Your Disability: Should you Say Anything? (1997). These may be obtained from the National AIDS Fund.

3.3.3 Programming Material

a. Mobilizing Talents and Skills, New York

The MTS guidebook Making Decisions about Employment, Benefits and Health Insurance: Returning to Work with HIV/AIDS contains information on how working affects benefits and medical insurance entitlements. MTS also publishes a quarterly newsletter and a series of pamphlets on its transitional employment model. The MTS Strategic Plan 1997-99 contains an overview of its programs and services and the anticipated increase in demand for them.

MTS is also discussed in Section 4.3 below.

b. AID Atlanta

AID Atlanta's Reconstruction package is a comprehensive manual containing modules for running information forums for PHAs on return-to-work issues. Each module addresses a different topic and contains handout materials and participant evaluations. Forum topics include "Creating a Reconstruction Program for your Community", "Separating the Myths from the Facts about Treatment Success", "Psychosocial Issues During a Time of Transition", "The Tangled Web of Public Benefits", "Financial Planning for the Indefinite Future" and "Tools for Re-entering the Workforce”. AID Atlanta offers technical assistance and support for other agencies seeking to adapt the package.

c. World Institute on Disability (WID), Oakland, California

WID is an international public policy centre on disability issues. It is currently revising its Vocational Rehabilitation and HIV/AIDS: A Resource and Training Manual (1994). Designed as a training manual for vocational rehabilitation service providers, it contains extensive sections on HIV as a disability, the medical, treatment, psychosocial and legal dimensions of HIV infection, best practice models in vocational rehabilitation, workplace accommodation, business and employment issues and an overview of particular US programs. Although the current edition of this manual pre-dates recent advances in the treatment of HIV, it is still quite a comprehensive resource for vocational rehabilitation workers new to HIV/AIDS issues.

WID also publishes the pocket-size Work for Life! An Employment Guide for People with HIV/AIDS (undated) which has information on reasonable accommodations and what to expect from the rehabilitation process.

d. Miscellaneous resources

A number of miscellaneous articles and references was obtained from Internet searches. These include bibliographies of HIV in the workplace resources and abstracts from academic journals.

Section 4: Consultations with AIDS Service Organisations

4.1 AIDS Service Organisations in Toronto

In Toronto, the two ASOs which offer advice about disability benefits (ACT's Insurance Benefits Clinic and the TPWAF case manager and benefits counsellor) currently appear to be the principal port of call for PHAs who are thinking about returning to work. This is consistent with the findings of our own and other surveys of PHAs which indicate that impartial information on disability benefits is the single most important, immediate need of PHAs who are thinking about returning to work. Almost all the other ASOs consulted in Toronto had referred clients either to ACT or to TPWAF for benefits advice.

Both the ACT clinic and TPWAF staff reported steady increases in the number of PHAs attending with queries about the likely impact of returning to work upon benefit entitlements. Individual ACT insurance counsellors report at least one person per session asking about this issue. However the issues described by volunteer and paid benefits counsellors at the two organisations reflected their different client bases.

4.1.1 Long Term Disability (LTD) recipients

The ACT clinic counsels people who are receiving benefits under an LTD plan, that is, it provides advice about issues arising under various types of insurance policies. These also include health and drug insurance plans and, until recently, a large number of “living benefits advances” under life insurance policies. This client group predominantly comprises white gay men between the ages of 20 and 40 years employed in white-collar occupations, including unionised white-collar and public sector employees.

PHAs in this client group tend to regard themselves as having "more to lose" than recipients of social assistance. The risk of losing sometimes generous LTD benefits is seldom matched by real prospects of rehabilitation with a previous employer, especially where the employment relationship has not been maintained during the period of disability. Clients generally are distrustful of insurance companies and anxious about the capacity of insurers to look beyond improvements in clinical status to broad workplace issues such as confidentiality and the potential for discrimination upon returning to a previous job.

4.1.2 Social assistance recipients

A significant portion of the client group at TPWAF comprises PHAs receiving disability support through a social assistance agency (either FBA, CPP, EI or GWA). This group often requires support around a broad range of issues (housing, income support and poverty, medical services, access to medications, substance use) amongst which HIV may not necessarily be the dominant factor.

Some of these PHAs have limited employment histories or educational qualifications. This group was likely to need pre-vocational and life skills training, case management and counselling (especially around confidence and self-esteem) before being able to actively pursue employment.

Presently, some TPWAF clients are thinking about working "under the table" due to fears about losing their current drug benefits. The effect of part-time work on continuity of benefits is complicated by the inconsistency of standards used by CPP and FBA. FBA offsets benefits according to the amount earned, while CPP assesses eligibility according to the number of hours worked.

The imminent replacement of FBA with the Ontario Disability Support Program involves a potentially dramatic change to eligibility for disability benefits in Ontario. GWA payments are also to be superseded by the Ontario Works (work for welfare) program. Despite assurances from the provincial government that people presently on FBA will be unaffected, the true impact of these changes for PHAs cannot yet be assessed. However, it is likely that they will cause considerable anxiety and result in an increased demand for benefits advice from ASOs (see Section 7 for further information about these changes).

Both ACT and TPWAF have made a very small number of referrals to existing vocational rehabilitation services in Toronto, but due to the recent nature of the return-to-work issue, have been unable to gauge the outcomes of these referrals for the individuals concerned.

4.1.3 Treatments

Queries to ASOs involved in providing HIV treatment information (principally CATIE in Toronto) usually raise the return-to-work issue in the context of access to medications. Continuity of drug coverage is a critical concern for any PHA considering a return to work. PHAs are also fearful that the prospect of high drug costs will act as a deterrent to prospective employers.

Ontario's Trillium Drug Program (Trillium) appears to intimidate some PHAs who feel that they are unable to afford the up-front deductible payable prior to accessing the scheme. The deductible is based on an assessment of the previous year's income, although PHAs who have not worked for a number of years may not have submitted recent tax returns and consider this requirement something of a hurdle. More importantly, PHAs are concerned about the 6-12 week waiting period for Trillium applications to be processed and consequently, possible gaps in drug coverage during any transition back to the workplace.

The likely impact of a work schedule on an individual's capacity to comply with different HIV drug regimens is also critical. Dosage and storage requirements, side effects, associated dietary needs and fluctuations in energy levels will influence any decision about returning to a particular work environment.

4.1.4 Ethnocultural communities

PHAs from ethnocultural minority groups often face a variety of employment barriers which are only compounded by HIV infection. These include language and cultural barriers to health care, treatment information, benefits advice and employment opportunities.

Although some PHAs would prefer to obtain work within their own communities, concerns about confidentiality and disclosure have also led to isolation for PHAs within these communities. While some had returned to previous employers, most were looking for new employment options. Service providers reported that boredom and a desire to re-take control of their lives (rather than financial motivation) were the main incentives for their clients considering a return to work. Some clients were concerned about being forced back to work by their insurers.

Services likely to be of assistance included information about rights as an employee with HIV, information about benefits and changes to social assistance programs and pre-vocational training (planning for work, preparing a resumé, explaining absence from the workforce to employers and colleagues). Vocational assessment, aptitude tests and career counselling were considered potentially helpful to those seeking a change from their former work. Computer skills was the most-frequently requested training need. Ongoing counselling and support through any transition back to work were thought to be essential.

Referrals which had been used by some of these organisations included career counselling at Canadian National Institute for the Blind (for a PHA with CMV retinitis), African Skills Training Centre and CANTC (Canadian-African Newcomers Training Centre).

4.1.5 Women

For women, living with HIV also compounds existing employment barriers such as family and relationship issues, children, substance use, sexual abuse and poverty. Women have been slower to take up combination therapy, and in their frequent role as caregivers for children, partners or older family members, often attach less priority to their own needs. Accordingly, few women involved in Voices were reported to be considering a return to work.

In addition to overcoming the barriers referred to above, Voices felt that its members were likely to need support to deal with low levels of confidence, self-esteem and assertiveness prior to contemplating any return to the workforce.

4.1.6 Prisoners

PASAN focuses its activities on providing support to PHAs who are presently incarcerated. Support for PHAs leaving prison usually involves referral to agencies such as the John Howard and Elizabeth Fry Societies. These agencies aim to stabilise ex-prisoners’ lives with assistance in housing, health care, treatments and income support.

Any programs aimed at assisting ex-prisoners living with HIV/AIDS must address the additional stigma of having a criminal record.

4.1.7 Health care workers and caregivers

Staff at Sunnybrook’s HIV Outpatient Clinic indicated that the return-to-work issue demanded a change of mindset for health care workers and other caregivers. As HIV changes, so do their traditional roles and responsibilities. Service providers are being required to reassess the nature of their work, and require education, information and referral resources in order to assist PHAs who are thinking about returning to work.

At the same time, hospital-based clinics were thought to offer considerable expertise in areas such as assessment of functional abilities, occupational therapy, support and counselling. Collaborations with them were thought to be potentially valuable.

4.1.8 Summary

The smaller ASOs in Toronto doing advocacy and support work for women, prisoners and in enthnocultural communities have to date dealt with the return-to-work issue only on an ad hoc basis for small numbers of clients. Issues for their clients cover the spectrum of concerns about continuity of drug access and benefits mentioned elsewhere in this report, but these barriers are often compounded or overshadowed by underlying social inequity and marginalisation.

While these ASOs anticipate an increase in queries about returning to work, they lack the resources, staff and referral information necessary to deal with them in a comprehensive way. The ACT clinic and TPWAF staff are currently the main points of referral. Small ASOs are therefore looking to ACT to provide leadership on return-to-work initiatives which are inclusive of their constituencies.

Many service providers are also being required to reassess the nature of their work and to develop new skills and attitudes in an uncertain, but more hopeful climate. Opportunities need to be provided for dialogue about the changes and challenges now being experienced by workers in ASOs and health care settings.

4.2 AIDS Service Organisations elsewhere in Canada

CAS is participating in the Health Canada HIV Rehabilitation Project, which is presently developing a resource on HIV and rehabilitation for physicians, rehabilitation specialists, community groups and the HIV community (this project is a module of the Comprehensive Guide to the Care of Persons with HIV Disease). In addition to providing information about rehabilitation for specific functional or cognitive impairments such as vision loss or dementia, the document will also address psychosocial issues about return-to-work and vocational rehabilitation. It is expected that this resource will be available in English and French in Spring 1998.

In October 1997, CAS received funding from Human Resources Development Canada's Opportunities Fund to conduct a national eight-month study entitled Labour Force Participation for PHAs: Opportunities, Barriers, Interventions. The objectives of this study are 1) to identify specific opportunities and barriers for PHAs in returning to or remaining in the workforce, 2) to identify innovative vocational programs and services and 3) to identify any changes required in public and private VR services and income support programs to better meet the needs of PHAs.

The project will involve a national PHA survey/needs assessment to be distributed through CAS member organisations, as well as community "roundtable" consultations with PHA organisations in each of the five CAS regions. This project is likely to draw and expand upon the preliminary work of this study. It is expected to be completed in late Summer 1998.

4.3 AIDS Service Organisations in the United States

Some American ASOs are now offering a variety of services designed to assist PHAs return to work, ranging from legal, financial and benefits clinics to programs similar to the AID Atlanta Reconstruction program (see section 3.3.3 above).

Two of the most prominent ASOs specialising in VR in the United States are discussed below. They are of interest because their services are founded on the premise that PHAs are more likely to remain in good health while they remain productive, social, working members of the community.

4.3.1 Mobilizing Talents and Skills (New York)

MTS was founded in 1988 by two New York University physicians who had observed in their own HIV medical practices that employed patients experienced fewer opportunistic infections, better mental and physical health and a superior quality of life than their patients who stopped working and went onto disability benefits. Their unemployed patients experienced more depression and lower self-esteem which, in their view, directly affected physical well-being.

MTS is the only non-profit organisation in New York which specifically helps PHAs to return to work or continue working. It offers up to 600 PHAs a year a comprehensive range of services including employment counselling, benefits analysis, job training and temporary and permanent employment services, based on its motto "employment is a treatment that works".

MTS services have evolved due to a strong relationship with New York's publicly funded vocational rehabilitation agencies, which now refer many of their own clients directly to MTS for vocational assessment and training.

4.3.2 AIDS Benefits Counsellors / Positive Resource (San Francisco)

Since 1988, the mission of AIDS Benefits Counsellors has been to maximise the financial independence and quality of life of PHAs through access to public and private income and insurance benefits. In 1996 it merged with Positive Resource, a PHA employment service organisation. The objectives of the two organisations are now 1) to strengthen the capacity of the AIDS service delivery system to cope with the changing client needs from advances in HIV therapy and 2) to integrate benefits counselling with vocational counselling and employment placement services, creating a "continuum" of services which respond to clients' needs.

ABC/PR employs a team of professional benefits counsellors and provides a job-listing service to PHAs. It refers clients to "job orders" placed by ASOs and other non-profit agencies as well as to jobs with employers who have approached ABC/PR as a temporary employment agency or because ABC/PR has asked employers to announce job openings to it preferentially.

Employment support is provided by weekly workshops which teach interview skills, employment rights, resumé writing, vocational skills analysis and job-hunting techniques. Other workshops provided by local experts include topics such as Working While Receiving Benefits, Employment Discrimination and Working with Temporary Placement Agencies. ABC/PR offers office computer training and co-ordinates its activities with government and community-based vocational rehabilitation agencies. ABC/PR facilitated over 450 successful job placements in 1996.

Section 5: Action Research Forum

5.1 Overview of Forum

The action research forum took place at the Central YMCA in Toronto on October 27, 1997. Twenty-one people living with HIV/AIDS participated in the forum, all of whom were both currently receiving some form of disability income and considering returning to the workforce. Over 100 people responded to the advertisement for the forum, which appeared in one issue of Xtra! and was distributed to local ASOs, outpatient HIV clinics and Toronto-based primary care physicians. Every attempt was made to ensure that the group reflected the diversity of the HIV community in Toronto.

5.2 Results of the Questionnaire

5.2.1 Sociodemographic items












The average period on disability for the participants was over four years. One-third of the group reported that their health had improved “a lot” in the previous 12 months, while a further third said their health had improved “somewhat”.

5.2.2 Work History

a. Previous employment

The group reflected a very wide range of previous occupations. These included positions in management, clerical/administration, service and hospitality, computers, sales, health care, the film industry, academic research and manual labour. Some had worked in a number of different fields.

b. Returning to previous employment versus new employment

Twelve of the twenty-one participants were considering returning to their previous employment. The remaining nine participants cited the following reasons for not wanting to return to their previous employment:


c. Reasons for leaving previous employment

For the majority of participants, the main reason for leaving their previous employment was poor health. However, a number of other reasons, including stress and discrimination in the workplace were cited as having contributed to their decision to leave work.

5.2.3 Returning to Work

a. Future expectations

As can be seen from the graph below, the vast majority of participants were feeling optimistic about their future:


“Now I have longer term goals than before I started feeling better.”

“It is difficult and scary to look beyond the past. But the past doesn't have to be the future. Doing something different from what you did before can benefit you.”

b. When to return?

Eighteen of 21 participants were hoping to return to work within the next 12 months. Some had already begun the search for employment or re-training opportunities. Half the group was currently doing some kind of volunteering.


c. Reasons for returning to work

Participants were asked to choose three reasons why they were considering returning to work, in order of priority:

The overwhelming priority in returning to work was to feel more productive and contribute more to society. Expanding one's social network was a secondary priority and a sense of responsibility to “work when well’. The desire to earn more money was cited less frequently.

“In my case it has been proven over the years that my best option is to have a purpose to get out of bed in the morning and face a fresh day.”

d. Role of the physician

Only half of the group had discussed with their doctor the possibility of returning to work.

e. The future work environment

Two-thirds of the participants were hoping to return to work part-time. Only 7 participants wanted to work full-time.

Participants were asked to highlight any special considerations they would require from an employer from a list provided.


The overwhelming need was for flexibility of hours or to work at home. For this group, physical needs in terms of workplace accommodation, traditionally a major component of vocational rehabilitation for people with disabilities, were not of major concern.

“Creating work-from-home situations would be ideal.”

5.2.4 Services Which Could Help

The chart below shows that participants prioritized financial and benefits advice as a service they needed during the process of assessing a potential return to work. Retraining, counselling (including career and self-esteem), job placement/listings and job search skills were also high priorities for many participants.

5.2.5 Concerns / Barriers to Returning to Work

Participants were asked to rank to what extent a particular issue was of concern to them. An extensive list of potential issues was listed (see next page).

The potential loss of benefits (both health and drug-related, as well as income and housing-related) was the issue of greatest concern to the largest number of people. A large number of people was also greatly concerned about dealing with issues around the flexibility of potential employment, including grappling with side effects at work, being able to attend regular doctor's appointments, having a ‘trial’ work period or part-time hours. Half of the group highlighted disclosure of HIV status as an area of concern, and a quarter had concerns relating to disclosure of sexual orientation. Half the group was concerned about their potential lack of skills and experience as a barrier to their returning to work.

5.3 Summary of Focus Groups

Participants were asked to expand on some of the issues related to returning to work that were highlighted in the questionnaire. In particular, attitudes towards work, barriers to returning to the workforce, and areas of potential support were explored.

5.3.1 Attitudes Towards Work

“I miss it.”

“I miss the money.”

“There's a loss of prestige if you don’t work.”

“Confronting my mortality has given me a value shift.”

“My old job never fulfilled me. I refuse to go back.”

“I used to be a workaholic. Career, career, career. Now, it's the importance of self care.”

“I want more.”

“I have mixed feelings as a woman. I never wanted to be at home, but now it's confusing. If you're feeling well, you're expected to work more on the home. Now, at home, do I have to iron shirts etc.?”

Clearly, many people's attitudes towards work have shifted as a result of their time on disability. People have not stopped learning or growing during their time out of the workforce. One of the challenges facing people who have been out of the workforce for a long period of time is to harness the skills, knowledge and awareness they have gained into marketable skills for employment. A complementary challenge for employers is to recognize and value different experiences of being on disability that may contribute to a potential employee's job performance and productivity.

5.3.2 Barriers to Returning to the Workforce

“If I go back to my previous job, I'm likely to be let go. I'm too expensive for my employer.”

“Symptoms could come back because of stress of work, bad air, bad working conditions.”

“I’d have to pay market rent. I wouldn't be eligible for children's services.”

“If I work I could end up earning the same or less.”

“I might not be able to pay for my drugs.”

“The system is a trap that prevents us benefiting from returning to work.”

Fear emerged as an overwhelming theme when the participants were asked about barriers to returning to work. Fear of losing benefits and drug coverage was paramount, especially for those receiving LTD benefits. In addition to these specific fears, a generally pervasive fear of change and taking risk was also evident.

Many of the most important barriers highlighted by participants require a re-thinking on the part of benefits providers, insurance companies and the health care system (both private and public) to enable the flexibility to make the risk of returning to work worth the gamble. Continuing access to the treatments which have enabled many people living with HIV/AIDS to contemplate returning to work is essential.
It is clear that services aimed at PHAs returning to work must also address the general fear of change and fear of taking risks found amongst the participants. To date, support mechanisms for PHAs have understandably focused on minimising risk and creating supportive environments. With the improvement in health now being experienced by many PHAs, it may be the time to encourage “healthy and productive” risk-taking (with appropriate information and support). Such messages should focus on the desirability of leading as full and productive a life as possible during periods of good health.

People who were over the age of 40 and had been out of the workforce for a significant period of time also talked of their age as being a barrier to returning to work (a recent University of Toronto study found that many employers ranked age second only to disability as a disincentive when hiring staff). Some spoke of fears of discrimination on the basis of their HIV status. It became clear from these discussions that there continues to be a need for HIV education in the workplace, and that discrimination, both real and perceived, is ongoing.

There appeared to be a significant difference between people who had LTD coverage and those receiving government assistance, such as FBA. The higher income received from LTD coverage was, at least financially, a disincentive to return to work. Those receiving lower disability incomes tended to feel less anxious about risking the loss of their benefits by returning to the workforce.

5.3.3 Areas of Potential Support

“The problem is that you have to do all the groundwork yourself. This increases my fear of being ‘found out’ and losing my benefits.”

a. Benefits advice and case management

Most people felt that any return to work would be greatly facilitated by assurances from public benefit providers and, particularly, insurance companies about continuity of drug coverage and medical benefits in the event that a return to work could not be sustained. Entitlements to both public and private benefits need to be sufficiently flexible to enable retraining, upgrading of skills and trial periods at work.

Benefit entitlements were seen to be “impermanent, always changing”, giving rise to an ongoing need for accurate, independent advice and information, especially for those considering a return to the same employer.

b. Counselling and peer support

The importance of peer support and counselling was repeatedly mentioned, particularly if directed at “gaining self worth, helping me sell myself”. Variations on the “What Now?” group at ACT were suggested (this 10-week support group explores a variety of current issues for PHAs experiencing improved health including return-to-work, travel, safer sex and facing the future). One-to-one counselling and case management were also considered important.

c. Guide to available resources

In addition to information about benefits, participants felt that any information that assisted them negotiate “the maze” of available employment assistance services would be advantageous (for example, “a booklet or manual with ‘tips’ to deal with different agencies’’).

d. Training

Suggested training needs included programs designed to teach facilitation skills, counselling and communication techniques, computer skills, how to write a resumé, how to present at a job interview and other job search skills. Insurance companies were seen to have a responsibility to assist financially with meaningful retraining, “not bird-brain courses” for those on LTD benefits.

e. HIV in the workplace programs

Some participants felt that it was not enough to prepare people living with HIV/AIDS for the workforce. The active development of work opportunities for people living with HIV/AIDS is necessary, by cultivating partnerships and developing programs with sympathetic and “socially responsible” employers. Educating sympathetic employers about issues for people living with HIV/AIDS was thought likely to increase prospects of people returning to sustainable employment in supportive environments. It was suggested that this could lead to the development of an index of HIV-friendly employers and perhaps even a jobs postings board.

Section 6: Insurance Industry

6.1 Consultations Held

A number of contacts were made with individuals working within or alongside the insurance industry. Sandra Dudley, a long-time volunteer at ACT’s insurance benefits clinic and an insurance consultant, was an invaluable resource. Meetings were held with the Canadian Life and Health Insurance Association (CLHIA) and Manulife Financial, the largest insurance company in Canada (with 136 HIV-related LTD claims). CLHIA provided information on a wide variety of insurers in Canada, and made contact with a number of companies on behalf of the project. Preliminary contact was made with Mutual Life, another large insurer. The consultants also attended the annual meeting of the Canadian Insurance Underwriters Association, which highlighted new treatments in HIV/AIDS as one of the sessions of the three-day meeting. Contact was made with the Medical Information Bureau (MIB), an industry-funded non-profit company which maintains a large database of individuals who have applied for disability insurance – the Disability Insurance Record Service (DIRS). The purpose of the DIRS is to prevent disability fraud. Telephone meetings were held with a number of individuals in the US who have been working with the insurance industry on return-to-work issues in HIV/AIDS.

6.2 Overview of Current Trends

Issues related to disability and returning to work within the insurance industry are very complex. As with other types of insurance (health, life, etc.) each individual or group policy is different, both within companies and between them. In an effort to minimise costs, employers will often negotiate a benefits package through an insurance broker. Consequently, employees may have LTD, extended health and life insurance coverage from three different companies. In order to assist PHAs who have been receiving LTD through private insurance, the individual's particular policy must be examined closely. The CAS Guide To Insurance Benefits For Persons Living with HIV/AIDS is near completion. A review of the draft document suggested that it will be a useful resource for PHAs and service providers.

From an industry perspective, LTD is no longer a profitable business. Medical conditions that have emerged over the past quarter-century, advances in treatments that keep people on LTD alive, mental health issues, as well as liberalized social attitudes mean that more and more people are claiming LTD and remaining on LTD for long periods of time. In response to this, the insurance industry on the whole is developing more efficient means of managing LTD caseloads, making it increasingly difficult both to get onto LTD, and to remain on LTD if clinical improvements indicate a potential to return to work.

Generally speaking, the insurance industry is not knowledge-driven. Advances in medical treatments and awareness of particular disease-states are not quickly disseminated within or between companies. LTD claims are, roughly speaking, divided into three streams:

1. Definite recovery prospects.
2. Disabled to 65 – cases reviewed only in the case of medical breakthroughs.
3. Total and Permanent Disability

Until recently, HIV-related claims were considered as part of the ‘total and permanent disability’ stream. Recent treatment advances are gradually resulting in shifting these files to be reviewed more regularly. Half of the PHAs on LTD who participated in the action research forum reported that they had been re-assessed by their insurer. Most were not fully aware of their rights and responsibilities with regards to their insurer, and found the experience of re-assessment to be stressful. Manulife has had an undisclosed number of its HIV-related claimants return to work in recent months.

6.3 Vocational Rehabilitation

Vocational rehabilitation is not, generally speaking, a contractual obligation on the part of the insurer. However, insurers have an economic incentive to facilitate claimants’ return to their previous employment if possible. This is by far the cheapest option on the insurers’ part, and they will facilitate this process wherever possible. Re-training in order to assist a claimant in re-entering the workforce in a different job or career area is considered in cases where:

1. It is unlikely (for any number of reasons) that the claimant will be able to return to his/her previous employment, and
2. It is likely that the insurers’ investment in re-training and vocational rehabilitation will lead to sustained employment and an end to LTD benefits.

6.3.1 Process for determining suitability for vocational rehabilitation

Insurers’ employ or contract large numbers of rehabilitation specialists to assist claimants in the return-to-work process. Upon a request from a claimant, or a company review of a claimant's file suggesting clinical improvement, the following steps are taken:

1. A medical re-assessment takes place.
2. If the assessment suggests strong prospects for a return to work, a rehabilitation specialist makes contact with the claimant. If the medical assessment does not demonstrate strong prospects for a return to work, the insurer would be reluctant to enter into a process of rehabilitation with the claimant, due to the costs involved.
3. The rehabilitation specialist works with the claimant to develop a “plan of action”.

6.3.2 Returning to previous employment

If the plan of action involves a return to previous employment, the employer will be contacted to discuss the claimant's re-entry into the workplace. The degree to which the claimant has remained in contact with her/his previous employer is often a good indicator of the potential for a successful return to work. LTD claimants are often not informed of the importance of continuing a relationship with the employer while receiving LTD benefits.

Depression can often be a barrier to returning to work, especially for long-term claimants of LTD. Rehabilitation specialists examine this issue closely and will work to help the claimant rebuild confidence and self-esteem. On the other hand, discrimination is not generally an issue that insurers have any responsibility to prevent. Contractually, if a claimant is able to return to her/his previous employment, and perform that job, the insurer's obligations are terminated. This is obviously an issue of concern to many PHAs, for whom discrimination in the workplace may have been a reason for going on LTD in the first place.

In most cases, a trial period of employment will be negotiated, where the claimant works part-time and continues to receive a top-up from the insurer until s/he is ready to return full-time. The trial period may continue for up to 2 years in some cases before the claimant is permanently removed from LTD. In rare situations, the insurer may agree (on a case-by-case basis) to allow the claimant to continue to work part-time indefinitely and receive a top-up in income replacement.

Insurers will encourage the employer to find ways to accommodate the LTD claimant. Unfortunately, the types of accommodations which employers are obliged to make for PHAs are not clear, and the insurer has no power to prevent the employer from terminating the claimant's employment once s/he has returned to work. It is the employer, rather than the insurer, which can often present the greatest barriers to a claimant's sustained return-to-work.

6.3.3 Re-training for new employment

If the plan of action involves re-training and an attempt to find new employment for a claimant, insurers will often try to partner with CPP to fund the re-training. An investment in re-training can be risky for the insurer, since many LTD contracts prevent the claimant from being taken off benefits unless employment can be found with >75% of previous earnings. There must be solid prospects that the claimant will find work in the area of employment for which s/he is being re-trained. The insurer will weigh opportunities versus cost in any decision regarding the funding of re-training.
6.4 Industry Needs Regarding HIV and Return-to-Work

Large insurance companies tend to fare better in terms of rehabilitation for their LTD claimants, and often the smaller companies look to the market leaders for models of good practice. All of the people who were consulted spoke of the need for industry education and information regarding the particular concerns of PHAs, including new treatments, issues of discrimination, specific workplace accommodation needs etc.

In October 1996, 120 insurance company staff and benefits consultants attended an HIV Education Seminar hosted by CLHIA and sponsored by Abbott Laboratories. In the light of further information about advances in HIV treatment, a repeat of such an event would be useful. The annual conference for insurance industry rehabilitation specialists would also be an excellent forum for HIV education to take place. Similarly, both Manulife Financial and CLHIA expressed interest in working to develop a pilot vocational rehabilitation program for PHAs, perhaps in partnership with CPP. A number of people consulted spoke of the need to work with employers on HIV-in-the-workplace issues, and a suggestion was made to begin with a survey of employers’ needs. This needs assessment could assist PHAs not only to return to work, but also to remain at work.

There is much work to be done within the insurance industry as a whole regarding the provision of information, education and advocacy on HIV disease. In the United States, the National AIDS Fund is attempting to bring industry leaders together to a ‘roundtable’ discussion on return-to-work issues. This could prove to be a fruitful endeavour in Canada as well. CAS might be the most suitable agency to organise such an event.

6.5 Summary

The input obtained from the insurance industry for this report suggests a more optimistic outlook for PHAs returning to the workforce than had been feared. There does not appear to be a wholesale attempt on the part of the industry to withdraw LTD benefits from claimants, either in Canada or the United States. Rather, individual cases are being reviewed on the basis of a person’s ongoing medical condition.

Insurers are bound by strict contractual obligations in most cases to ensure that a claimant is able to return to her/his previous employment at a minimum of 75% of pre-LTD earnings, for a significant period of time, before benefits can be discontinued. The response from insurers was enthusiastic about developing rehabilitation plans for PHAs that reflect the specificities of HIV disease and the individual claimant.

Further HIV education for policy-makers and rehabilitation specialists appeared to be welcomed, if not solicited, by the representatives of industry that were contacted. The bottom line seems to be that the insurance industry, like any other, is a business, driven by the profit motive. Vocational rehabilitation makes good business sense to an insurer who may be facing the prospects of paying lifelong benefits to a claimant. However, if the investment in rehabilitation is not likely to result in a long-term reduction in costs, it is not worth the gamble.

Section 7: Government Disability Benefits Programs

7.1 Consultations Held

A review of existing federal and provincial programs that provide disability benefits to PHAs was undertaken. Imminent policy changes and available literature were examined. In addition to this, a number of telephone and in-person meetings were held with individual representatives of these programs, including Canada Pension Plan (CPP) at the federal level, and Family Benefits Allowance (FBA) at the provincial level. The federal Employment Insurance Program (EI) was also consulted, since many people receive EI benefits prior to going on CPP. Similarly, the provincial GWA program was also consulted, as many people receive welfare benefits before going on FBA.

Many PHAs are receiving combined disability benefits from provincial and federal programs (FBA and CPP). The eligibility for CPP disability benefits is dependent on working and contributing to CPP for a minimum time period. This is discussed later in this section. Similarly, most people receiving LTD benefits through private insurance are also receiving CPP, since LTD is offset by the income provided under CPP.

The fact that many PHAs are receiving disability benefits from a number of sources adds to the confusion for people considering re-entering the workforce. Different rules, regulations, and opportunities for vocational rehabilitation apply to different programs. This section attempts to provide some clarity regarding the current trends in each program, their vocational rehabilitation procedures and the potential for partnerships amongst programs. A description of the perceived needs of these programs for HIV-specific information, education and advocacy is also included.

7.2 Overview of Current Trends

7.2.1 Family Benefits Allowance (FBA) and General Welfare Assistance (GWA)

As of January 1, 1998, the Ontario government's Social Assistance Reform Act will replace the laws on FBA and GWA with the Disability Support Program Act (ODSPA) and the Ontario Works Act (OWA). The most fundamental change in eligibility requirements for disability benefits will be an assessment based on ‘functionality’ rather than ‘employability’. Employability refers to job skills, education, and the ability to work with others. Functionality refers to the physical ability to care for oneself, move around, and function in the community and the workplace. Under the new law, anyone applying for disability benefits in Ontario will have to demonstrate:

1. Suffering from a “substantial physical or mental impairment that is continuous or recurrent and expected to last one year or more”,
2. The “direct and cumulative effect” of the impairment is to substantially restrict ability to look after one's personal needs such as eating, dressing, hygiene and ability to function in the community or in the workplace, and
3. The impairment, its duration and one's restrictions have been verified by a doctor or a professional.

Furthermore, alcohol and drug addictions will no longer qualify as disabilities.

Ontario Works, which will replace GWA, may mean that PHAs who are currently on welfare will have to spend several hours weekly looking for work, or will have to perform work in some community service, in order to receive benefits.

The new laws will clearly make it more difficult for PHAs to be eligible for benefits. However, the government has stated thus far that people currently receiving benefits will continue to receive them. Some assurance has also been given that treatment regimens/side effects and HIV confidentiality will be taken into account. This remains to be seen.

Anyone currently receiving FBA is entitled to work part-time without losing his or her benefits. However, FBA must be informed, and 75% of any earnings after taxes, CPP and EI contributions, minus the basic allowance ($160 per month single, $185 per month family) will be deducted from the next month's benefits cheque. People on FBA who are returning to work may be eligible for an ‘employment start-up benefit’ of $253, to cover such things as new clothes, transportation to and from work etc. Once a person has returned to work full-time, benefits are terminated. If a person stops working due to the previous disability within one year of the termination of benefits, s/he may reapply to FBA with no medical required.

The overwhelming current trend in provincial disability programs is one of increasingly strict eligibility criteria and a move to return as many people as possible to the workforce.

7.2.2 Canada Pension Plan (CPP) and Employment Insurance (EI)

CPP is also due to be restructured as of January 1, 1998. Changes in demographics have led to an increasing percentage of Canadians receiving retirement pensions from CPP, as well as a large increase in CPP disability recipients over the past quarter-century. Consequently, CPP is apparently running out of funds. Employee contributions are set to increase, and eligibility criteria are being tightened for disability benefits.

The most important change to the eligibility criteria relates to the number of years one must have worked and contributed to CPP. As of January 1, 1998 a claimant must have worked and contributed four out of the past six years. Previously the requirement was two of the previous three years or five of the previous ten years. The new eligibility criteria will apply only to new claimants. Anyone approved before December 31, 1997 will continue to receive benefits.

Anyone who is receiving CPP disability benefits and returns to work will, upon notifying CPP, continue to receive full benefits for three months after beginning work. After three months, CPP benefits will be terminated. If the person is unable to continue working due to a recurrence of the previous disability after the three month period is over, s/he must reapply to CPP. Apparently, however, if the person reapplies within five years the application may be ‘fast-tracked’. The details regarding this ‘fast-tracking’ policy were not made available to the consultants.

The EI program – formerly the Unemployment Insurance (UI) program - has also undergone substantial reforms in the past year, including stricter eligibility criteria and shorter periods of coverage. Many PHAs who leave employment due to disability receive sick benefits coverage from EI prior to gaining disability benefits. EI is mentioned in this report primarily because the employment resources provided through its Human Resources Centres of Canada (HRCC) may be of value to PHAs attempting to return to work. These will be discussed further in the following section.

7.3 Vocational Rehabilitation

7.3.1 Family Benefits Allowance

Vocational Rehabilitation Services (VRS) is the provincial agency responsible for people with disabilities on FBA. Persons may contact VRS through their FBA support worker for an assessment. However, the waiting period for an assessment may up to 8 months.

The assessment will involve a number of components:

1. Medical – including the extent of the disability and how it affects work
2. Social – social and personal strengths and how these relate to vocational planning
3. Vocational – an employment history is reviewed as well as skills and interests
4. Psychological – an assessment of the individual's skills and aptitudes to do specific types of work
5. Work Trial – the ability to work in an actual job situation is explored

VRS will often refer people to community-based vocational rehabilitation agencies for services. These are reviewed in the community-based VR agencies section of this report.

The consultants encountered a number of complaints from AIDS service workers and PHAs who had attempted to access VRS through FBA. These complaints related mostly to the lengthy waiting lists. It appears that VRS is suffering from chronic under-resourcing and the continual shifts in policies and procedures vis a vis people with disabilities in receipt of FBA.

7.3.2 Canada Pension Plan (CPP) and Employment Insurance (EI)

A National Vocational Rehabilitation Project was completed last year by CPP, which has now become the National Vocational Rehabilitation Program. According to one source, CPP saved over $40 million during the first year of the pilot project.

The program is geared to anyone on CPP disability benefits who is under the age of 50, not terminally ill, medically stable, and motivated and willing to participate. In order to determine suitability, upon a request from a CPP claimant (or after a CPP-initiated review of a claimant's file), CPP will:

1. Medically re-assess and review file to determine suitability.
2. Make contact with the claimant.
3. Obtain verbal, then written consent from the claimant to proceed.
4. Release claimant's file to a rehabilitation consultant, who is contracted out.

The rehabilitation consultant will then:

1. Perform a vocational assessment, including physical, emotional/psychological, work history, education, interests etc.
2. Determine possibility of returning to any previous employers, and make contact with them if necessary.
3. Make recommendations to CPP on rehab services, including a costed plan.

CPP will then make a decision on approval of the plan. If it is approved by CPP and the claimant, the plan will proceed, using the services of local community-based vocational rehabilitation services. Disability benefits will continue to be paid until three months after completion of the program, regardless of whether employment has been found. If employment is found before the end of the program, benefits will still continue until three months after beginning work.

Attempts will be made to share costs of the Vocational Rehabilitation Program with other benefit providers of the claimant, such as private insurers or provincial disability benefits programs (FBA in Ontario), who will act as partners in the rehabilitation process. CPP is also eager to develop partnerships with community-based agencies working with specific disability groups.

EI has a number of programs available to assist people in returning to work. Two of these, the Targeted Wage Subsidy Program and Reachback may be of use to PHAs who have received EI/UI benefits in the past three years.

The Targeted Wage Subsidy Program is designed to assist people with any number of employment barriers to re-enter the workforce. Employers who hire people under this program receive a time-limited wage subsidy from the federal government (capped at 70% of the employee's salary). ‘Job developers’ can be contracted through community-based VR agencies for specific target groups. These job developers may work directly with other community-based agencies to provide VR services. As the various branches of HRDC are quite autonomous, the types of wage subsidies offered tend to vary between different branches (the Yonge/St Clair HRDC office in Toronto was identified as a branch with expertise in this program). There is not, as yet, an HIV-specific Targeted Wage Subsidy Program. Some advocacy may therefore be required to develop a case that PHAs are an appropriate "target" group under the program (See Section 8 for more information about this program).

The Reachback Program is designed to assist people who have been unemployed for a long period of time to return-to-work, by providing careers counselling, re-training, job search skills and other resources.

A current trend in EI is the provision of Human Resource Centres of Canada (HRCC) facilities located across the country which provide resources to assist people to return to work. Toronto has a number of HRCCs, most of which provide written resources, access to computers and other job search tools, as well as job listings and re-training opportunities. The services of HRCCs can be accessed by anyone who has received EI benefits in the past 5 years. GWA, or Ontario Works, also maintains a number of resource centres with facilities to assist people in a job search.

7.4 Needs Regarding HIV and Return-To-Work Issues

It was clear that there is a strong need for information and education regarding HIV-specific return-to-work issues for all governmental disability benefits providers, both federal and provincial. In particular, there appeared to be a lack of awareness of treatment information and the ongoing treatment access needs of PHAs. In addition, there appeared to be a lack of awareness of the specific accommodation needs of PHAs in returning to work, including the possibility of cyclical disability, flexibility in the workplace, and the need to challenge AIDSphobia and homophobia in the workplace.

General information regarding the availability of vocational rehabilitation programs is not widely disseminated. Governmental agencies need the support of community-based agencies working with people with disabilities to make the information widely available to their service users.

At the federal level, one representative of CPP expressed the need to develop a model of good practice in vocational rehabilitation for PHAs, and a willingness to assist in negotiating a potential partnership to pursue this, possibly with the insurance industry and ACT.

Most representatives contacted spoke of the need for ongoing advocacy from disability communities to strengthen and secure public programs aimed at supporting people with disabilities to remain in and re-enter the workforce.

7.5 Summary

It was encouraging to discover that, as with the insurance industry, there does not appear to be a wholesale attempt on the part of governmental agencies to terminate disability benefits for PHAs. Cases are reviewed on an individual basis to determine the suitability of a person to receive vocational rehabilitation services and return to work. There does not seem to be any assumptions made that because of recent advances in HIV treatments, HIV disease is “over”.

On a less positive note, disability benefits, both federal and provincial, have not escaped the cutbacks which have affected other social programs. Eligibility criteria are increasingly stringent, and management of case files is becoming gradually more efficient in the interests of cutting costs. The emergence of the numerous vocational rehabilitation programs outlined has also clearly been driven by budget reductions. However, the programs reviewed were fairly comprehensive in addressing the physical, emotional/psychological, and skills-related needs of people who have been out of the workforce for long periods of time. It is the case that the outcomes of such programs are being increasingly measured in terms of “numbers back in jobs” rather than by measuring less tangible “quality of life” improvements. However, ensuring that the specific needs of PHAs are addressed within these programs appears to be a task that could be accomplished effectively.

Section 8: Community-Based Vocational Rehabilitation Services

8.1 Consultations Held

During the course of this project contact was made with Goodwill, Jewish Vocational Services, Ontario March of Dimes, The Centre for Advancement in Work and Living and The Training Co-ordinating Group for Persons with Disabilities. Some information about services offered by private vocational rehabilitation consultants was also obtained.

8.2 Overview of Vocational Rehabilitation (VR) Services

The sample of community-based VR organisations consulted offers a large number of assessment, counselling, training and placement services to a range of disability groups. Eligibility for particular services may depend upon the nature of the disability or other employment barrier and other "intake criteria" may apply. Most agencies provide services only on a fee-for-service basis or accept clients only upon referral (on a fee-sharing basis) from a private insurer, FBA, CPP, EI or GWA (cross-referrals and cost-sharing arrangements of this kind are common across the entire rehabilitation sector).

Some agencies also perform job development (marketing people with disabilities to particular employers) and will work with other organisations to tailor programs to their clients' needs.

Examples of the more relevant services available appear below.

Goodwill Toronto

Goodwill's Work Training and Employment Services Department offers vocational and work tolerance assessment, supervised job search and placement and an employment resource centre (jobs board, use of computers, workshops). In partnership with other agencies and colleges it provides specialised training programs in computers, customer service and various trades. Some intake criteria apply, and services are offered on a fee-for-service basis or where clients are sponsored by another source.

Ontario March of Dimes

March of Dimes aims to provide "independence for adults with physical disabilities" through employment services such as vocational assessment, supported employment and job placements, job skills training (especially computers). It also operates a Job Finding Club, conducts workshops on human rights issues and has an employment resource centre. Client sponsorship by a benefits provider is usually necessary.

Jewish Vocational Services (JVS)

JVS offers an extensive range of employment preparation and training services. For example, its Vocational Adjustment Program is designed to assist individuals who have difficulty securing and maintaining employment due to psychological and social barriers. This program addresses "personal growth" issues and vocational exploration based on aptitude, interest and personality testing. Information sessions on JVS services take place monthly.

The Centre for Advancement in Work and Living (CAWL)

CAWL provides training and job development to people with a range of employment barriers, such as new immigrants, older displaced workers and young offenders. It accepts referrals only from "community partners" such as Family Benefits, GWA, EI and CPP.

CAWL has also completed a number of individual contracts with agencies requiring job development services for their client groups. For example, it loaned a job development specialist to the Canadian Mental Health Foundation for three days a week to develop a specialised program marketing people with psychiatric disabilities to CAWL's network of supportive employers. Similar projects have been contracted to CAWL by HRDC under the Targeted Wage Subsidy Program (see below and Section 7.3.2).

Training and Co-ordinating Group for Persons with Disabilities (TCG)

TCG aims to "increase training and employment opportunities for persons with disabilities in Ontario". Funded by HRDC's Employment Assistance for People with Disabilities Program and Opportunities Fund, its focus is on job development for people across the range of disability groups. TCG also provides vocational counselling, purchases training programs from other agencies and conducts workshops and monthly information sessions on job seeking skills. Its services are available mainly to people receiving social assistance benefits.

Other agencies

Springboard is another large organisation funded by HRDC to provide counselling, employment assessments, career exploration and training for people with employment barriers. The Seeds of Hope Computer Learning Centre, Working Skills Centre, Humber College and some Adult Learning Centres were also reported to offer a range of vocational training programs. It was not possible to make contact with these organisations before the completion of this project.

The issue of job accommodation is not dealt with extensively in this report, as the kinds of accommodations which people living with HIV might now require in the workplace are more likely to involve flexibility of work schedules than physical accommodations such as ramps and other alterations (although these may also be required in some cases). However this issue is likely to become of increased importance and warrants further examination. The Job Accommodation Network, a cost-free national 1800 phone service offering advice and information about workplace accommodations for people with disabilities, is suggested as one potential resource in this area.

8.3 Suitability to PHAs of Services Available

Not surprisingly, the agencies consulted had minimal experience with PHAs, although some reported having had "one or two" clients. However, nearly all those consulted expressed considerable confidence and enthusiasm about their capacity to apply their experience with other disability groups to the needs of PHAs. It was felt that PHAs were likely to share many of the same employment barriers as people with other disabilities (such as people with mental health problems or people with other chronic illnesses). Employment barriers common to all these groups include depression as a result of being out of the workforce for lengthy periods, ongoing treatment and medical needs, stigmatisation and discrimination, lack of confidence or self-esteem and training needs (particularly computer skills).

Both March of Dimes and JVS felt that they would be well equipped to devise programs addressing PHA needs. It was suggested that any such program should first address confidence and self-esteem amongst PHAs by adapting models currently in use. The JVS Vocational Assessment Program, for example, includes topics such as assertiveness, stress management, identifying altered and distorted realities, dealing with failure, rejection and criticism, overcoming procrastination, dealing with anger and conflict, dealing with boredom, risk-taking and problem solving. Each of these agencies is willing to explore potential partnerships with ACT.

The representatives of CAWL and TCG were encouraging in their enthusiasm about the openness of the labour market to employment equity programs. They were also enthusiastic about including PHAs in their programs and activities. ACT should examine the potential models of job development which these two agencies offer and the potential of seconding job development staff from either of them directly to ACT. HRDC's Targeted Wage Subsidy Program is one possible means of pursuing these avenues. The organisations consulted which had successfully accessed this program thought that it had considerable potential to expand the employment options of PHAs (see also Section 7.3.2).

8.4 Needs Regarding HIV and Return-to-Work Issues

It was acknowledged by most of the agencies consulted that their staff would benefit from further education about HIV issues, and it is very important that such education be given priority in any future collaboration.

8.5 Summary

At least three or four of the community-based organisations in Metro Toronto which are currently providing vocational rehabilitation and employment services to people with disabilities and other employment barriers offer potential for collaboration with the HIV sector. A considerable pool of appropriate expertise already exists. The return-to-work issue involves a real opportunity for ASOs to develop practical links with the wider disability sector, which have to date been relatively elusive. By so doing, ACT would obviate any necessity in the short term to "reinvent the wheel" by duplicating services which are already available elsewhere.

ASOs working with prisoners and ethnocultural minority groups are currently referring some clients to organisations which provide vocational rehabilitation services tailored to their communities. While these services were not able to be assessed for this project, their potential contribution to future programming should be explored.

Section 9: Recommendations

This section outlines the recommendations of the consultants for ACT to address the issues covered in this report. The recommendations are divided into eight areas: Immediate Actions, Pilot Study in Vocational Rehabilitation for PHAs, Benefits Advice, HIV in the Workplace, PHA Information and Education, Information and Education for Community-based Vocational Rehabilitation Organizations, Information and Education for the Insurance Industry, and Treatment-Specific Issues.

Each section lists a number of recommendations for action, in order of suggested priority.

Section 10 includes suggestions on particular areas of the recommendations for which potential funders may be suitable.

9.1 Immediate Actions

Priority 1: Verbally present study findings to ACT board, management and staff. It is also suggested that the board, management and staff of TPWAF be invited to attend.

Priority 2: Distribute copies of report as soon as possible to interested PHAs (particularly participants of the action research forum), Toronto-based ASOs, HIV outpatient clinics, CLHIA, Manulife Financial, community-based vocational rehabilitation agencies, Glaxo Wellcome, CAS, BCPWA and MIEL Quebec (which is about to conduct a similar study in Quebec City).

Priority 3: Facilitate workshop for service providers on return-to-work issues at the CAS National Skillsbuilding Symposium in January, 1998 (this workshop has already been organised and included in the conference program).

Priority 4: Present findings at a large public forum for PHAs. Individuals who expressed an interest in the action research forum, but were not able to attend, should be contacted.

Priority 5: Host forum for AIDS service providers to explore issues related to PHAs returning to work, and in particular the shift in focus of frontline work from care and support to one of facilitation of increased participation of PHAs in society.

Priority 6: Establish a Return-to-Work Working Group, which should include participation from outside ACT, including PHAs, CATIE, other ASOs, HIV outpatient clinic staff.

9.2 Pilot Study in Vocational Rehabilitation for PHAs

The proposed study would have as its goal the development of a model vocational rehabilitation program for PHAs, which would serve as a cornerstone for the delivery of VR programs in Toronto.

Priority 1: Negotiate funding partnerships with HRDC (see Section 10), CLHIA, Manulife Financial, and corporate (non-insurance industry) funders, especially the pharmaceutical industry and a large HIV-friendly employer.

Priority 2: Establish a steering committee comprising representatives of funding partners, PHAs, and service providers.

Priority 3: Review US models that have been developed (see literature index in Appendix C).

Priority 4: Develop and pilot comprehensive VR model, drawing on good practice in other disability areas, but focussing on HIV-specific issues.

9.3 Benefits Advice

Priority 1: Develop formalized partnership between ACT Insurance Clinic and TPWAF benefits counselling programs.

Priority 2: Develop and deliver training sessions for volunteers and staff of these programs. Review literature in Appendix C and further explore existing models of benefits analysis developed in the United States.

Priority 3: Develop and deliver training sessions for volunteers and staff of other ASOs, including Voices of Positive Women, ethnocultural groups and PASAN.

Priority 4: Expand ACT/TPWAF benefits services. Recruit volunteers and additional staff if possible.

Priority 5: Promote the ACT/TPWAF benefits services more widely in the community, to other ASOs and health care providers.

Priority 6: Develop a written 'benefits guide' of issues to consider regarding benefits for PHAs considering returning to work.

9.4 HIV in the Workplace

Priority 1: Design and deliver survey on employer needs/issues regarding PHAs in the workplace - include small, medium and large employers in the survey sample.

Priority 2: Organise training workshops and written materials for employers, based on results of survey.

Priority 3: HIV-specific Targeted Wage Subsidy Program - explore funding potential with HRDC for a job developer to be contracted out to ACT from a community-based vocational rehabilitation agency, such as TCG or CAWL (see sections 7 and 8).

Priority 4: Review ACT corporate donor list. Explore these employers' HIV in the workplace policies. Create list of HIV-friendly employers in Toronto, and distribute this list to PHAs, ASOs, health care providers and media.

Priority 5: Develop relationships with employers, with long term goal of creating a jobs listings board at ACT.

9.5 PHA Information and Education

Priority 1: Contract community-based vocational rehabilitation agencies, such as JVS, March of Dimes, TCG or CAWL (JVS has a specific program on anger management in the workplace for people with disabilities, for example), to deliver a series of general workshops for PHAs at ACT on a number of issues, including:
  • Confidence-building and self esteem
  • Prevocational life skills
  • Job search skills, writing a resumé, interview techniques etc.

Priority 2: Develop a brief pamphlet for PHAs on return-to-work issues, which describes the obstacles and acknowledges the fears arising when thinking about returning to work, but which highlights the value of taking “healthy” risks during periods of good health.

Priority 3: Develop a written guide to VR agencies and programs in Toronto and how to access their services, including programs for specific ethnocultural minorities, ex-prisoners, women and substance users. This could supplement CAS's Guide to Disability Benefits for Persons Living with HIV/AIDS.

9.6 Information and Education for Community-based Vocational Rehabilitation Organisations

Priority 1: Foster relationships with provincial Vocational Rehabilitation Services (VRS) and individual community-based organisations, specifically CAWL, TCG, JVS and March of Dimes.

Priority 2: Explore possibility of funding HIV-specific VR programs for people on FBA through HRDC's Employment Assistance for People with Disabilities Program (EAPD), formerly the Vocational Rehabilitation of Disabled Persons Program (VRDP).

Priority 3: Develop and deliver a one-day training workshop in HIV-specific issues for VR agencies.

Priority 4: Write and distribute a pamphlet on HIV-specific issues for frontline VR intake workers. Review US models in the literature in Appendix C (specifically, the WID manual).

9.7 Information and Education for the Insurance Industry

Priority 1: Liaise with CAS to pursue a national roundtable discussion with policy-makers in the Canadian insurance industry regarding return-to-work issues for PHAs.

Priority 2: Develop training workshop for annual rehabilitation specialists' conference, through liaison with CLHIA.

9.8 Treatment-specific Issues

Priority 1: Partner with CATIE to develop information on treatment issues in the workplace.

Priority 2: Encourage CATIE to coordinate systemic advocacy with provincial and federal governments on treatment access issues, including reform of the Trillium Drug Program and the establishment of a national pharmacare program.

Priority 3: Include treatment-specific materials developed by CATIE in VR pilot study, EADP program with FBA (VRS), and in educational initiatives to insurance industry, community-based VR agencies, employers, ASOs and PHAs.

9.9 Conclusion

The recommendations described in this section are by no means exhaustive. They are, however, extensive. It must be emphasized that return-to-work and HIV in the workplace issues may have an impact on all frontline services and programs offered by ACT. Consequently, any new programming addressing these issues should be integrated into ACT's entire programs and services strategy.

The consultants have not addressed staffing implications. However, a comprehensive effort to assist PHAs to return to the workforce may entail the need for additional staff. While it may be prudent to appoint a coordinator to oversee all return-to-work and HIV-in-the-workplace programming, the extent to which additional staff is engaged will obviously depend on the priorities adopted and the procurement of appropriate funding.

Section 10: Sources of Potential Funding

The sources of potential funding described below are divided into public sector funding sources (federal and provincial) and corporate sector funding sources. Particular recommendations for programming are matched to specific potential funders. The list of potential funding sources is by no means comprehensive.

10.1 Public Sector

10.1.1 Federal

a. Human Resources Development Canada (HRDC)

i. Opportunities Fund

The Opportunities Fund is a three-year $30 million per year fund introduced in fiscal year 1997/98. The Opportunities Fund is designed specifically to assist people with disabilities to return to the workforce. The fund is available to individuals who are ineligible for Employment Insurance benefits, but have been receiving disability benefits from CPP and/or CPP and private LTD insurance. It provides financial assistance to pay for job-training, tuition, start-up funding for a new business or other costs associated with returning to work. The fund is also available to agencies which provide services to people living with disabilities and who are interested in using OF monies to develop innovative programs to assist people with disabilities to return to work.

The Opportunities Fund would be an appropriate source for partial funding of the pilot study in vocational rehabilitation of PHAs, in conjunction with matched funding from the corporate sector. It may also be appropriate to include other recommendations into the proposal for funding, specifically an expansion of ACT's insurance clinic and Toronto PWA Foundation's benefits advice service, the employer needs survey, employer education program, benefits guide manual and guide to VR services in Toronto.

ii. Employment Assistance for People with Disabilities (EADP)

The EAPD is a program that reimburses 50% of eligible costs for a wide range of vocational rehabilitation programming provided by provincial governments. The focus of funding for the EADP is in two streams: individual vocational rehabilitation and a "partnerships and innovation" component that would support research demonstration projects, best practices and other initiatives related to vocational rehabilitation of persons with disabilities who are receiving provincial disability benefits (FBA in Ontario).

Funding through this source would be through a partnership with provincial VRS for HIV-specific VR initiatives for people on FBA.

b. AIDS Community Action Program (ACAP)

Pending announcement of the details of Canada's Third National AIDS Strategy, ACAP (which may be renamed in the Third Strategy) is a source of funding for HIV-specific community-building initiatives. It may be a good source of time-limited project funding for return-to-work initiatives. In particular, an information and education campaign targeted at all PHAs regarding return-to-work issues, including a promotional campaign on "healthy risk-taking", could be funded through ACAP, as well as the development of an HIV-friendly employers list and jobs listings board.

10.1.2 Provincial

a. AIDS Bureau, Ontario Ministry of Health

The AIDS Bureau may be a good potential source of matched funding for monies received through EAPD (see above) for programs targeted to PHAs who have been receiving disability benefits through FBA.

b. Trillium Foundation

Trillium funding is aimed at projects which strive for social transformation and the elimination of oppression and discrimination. HIV-in-the-workplace initiatives targeting employers may be a suitable initiative for Trillium funding.

10.2 Corporate Sector

a. Insurance industry

CLHIA, in conjunction with one of its member companies (Manulife, for example) is a potential source of matched funding with the Opportunities Fund for the pilot study in vocational rehabilitation for PHAs. CHLIA would be a potential funding source for any information/education/advocacy initiatives targeted to the insurance industry.

b. Pharmaceutical industry

The pharmaceutical industry has reaped the financial benefits of recent advances in the treatment of HIV disease. The companies that market HIV antiretrovirals - Glaxo Wellcome, Bristol Myers-Squibb, Hoffman-La Roche, Abbott Laboratories, Merck-Frosst and Agouron - could prove to be a valuable source of funding for return-to-work programming. Glaxo Wellcome has expressed to the consultants an interest in negotiating possible funding in this area.

c. Levi Strauss

Levi Strauss has funded job development projects with the local VR agency TCG (Training and Coordinating Group for People with Disabilities) for a disease-specific disability group in the past. Furthermore, Levi's has identified HIV as a priority area for its charitable donations.

d. Other corporations who have donated to ACT

It would be prudent to pursue funding for return-to-work initiatives with corporate donors who already have a relationship with ACT.

Rather than seek funding on a piecemeal basis, the consultants recommend that ACT develop a comprehensive strategy for addressing return-to-work issues for PHAs, which includes the recommendations outlined in this report. The federal, provincial and corporate funding sources identified in this section should be included in the development process of this strategy.
