O Departamento de Imigração do Canadá, isto no caso da maioria das classes de imigrantes, pode recusar autorização de residência permanente se a pessoa for VIH positiva. A única classe de imigrante, a qual o estado do VIH não é aplicável ou relevante, é a classe de refugiado (Refugee Claimant).
In most cases of immigration to Canada, or being allowed to remain in Canada, Citizenship and Immigration Canada will deem a person unable to stay if they are HIV reactive (HIV-positive). The only category where their HIV status is not of relevance in determining if a person can stay in Canada is the category of “Refugee.”
Alguns Oficiais de Immigração do Departamento de Alfândega do Canada (Canada Customs and Revenue), não tem deixado entrar pessoas as quais tinham medicamentos do VHI na bagagem. Por vezes e neste caso,a pessoa poderá receber autorização para entrar e/ou permanecer no país, caso prove que possa pagar pelos medicamentos e serviços médicos.
É importante notar também, que mesmo debaixo destas condições, a entrada no país não é garantida.
Canada Customs has prevented non-Canadians from entering Canada at the border if customs agents have found HIV medications in the traveller’s luggage. An individual in this situation may be allowed into Canada if they are able to prove that she or he is able to pay for any necessary medical services while she or he is in Canada and falls sick. (Entry to the country is not guaranteed even under these circumstances.)
Caso a pessoa estiver tratando do processo de se legalizar no Canadá, ou mesmo se reside actualmente no país, mas não está legal, pode fazer o teste anônimo aoVIH. Não é necessário informar o resultado a qualquer autoridade governamental. As clínicas anônimas no Ontário, não exigem o cartão de saúde (OHIP CARD) or qualquer outra identificação. Estas clínicas anônimas não são obrigadas a informar o resultado do seu teste ao Official de Saúde Pública (Medical Officer of Health), autoridade a qual existe em todas a regiões do Ontário.
If an individual is in the process of immigrating to Canada, or they are not legally in the country, they can get tested for HIV without the government finding out about their getting tested or the results of the test by going to an “Anonymous HIV testing Clinic”. Anonymous testing clinics in Ontario do not ask for Ontario Health Cards or ID to test for HIV. If the clinic is providing an anonymous test for HIV they are also are not required to report the individual to the Medical Officer of Health (MOH - the head of a public health unit in a given region if the individual tests reactive (HIV-positive) for HIV.
Muitas pessoas preferem fazer o teste no médico de família, especialmente se este fala o seu idioma. O médico não tem que usar o cartão de saúde (OHIP Card) para fazer o teste do VHI. Ele pode enviar o sangue um laboratório particular, sendo assim a pessoa responsável pelo custo do teste. É importante notar que no caso do resultado teste ser positivo, o médico de familia é obrigado a enviar o resultado para o Oficial de Saúde Pública.
Many people prefer to go to their own doctor for an HIV test, especially if the doctor speaks their own language. They should be aware that if a doctor does not bill the Ontario Ministry of Health, (thereby not requiring an Ontario Health Card from the patient), and instead arranges for the test via a private laboratory with the patient paying the cost, if the result is reactive (HIV-positive) the doctor is usually obliged to report the case to the Medical Officer of Health.
